Patent Bots Prep & Pros – Detailed Overview and Training

Implications of File History Estoppel During Litigation

Speaker: Niky Bagley
Niky's practice is focused on patent and other intellectual property litigation in a variety of forums. She has litigated a wide range of cases on both the plaintiff and defense side, primarily involving the electronic arts and software design and application, including microprocessors and integrated circuits, sensors and detectors, virtual reality interfaces, encryption algorithms, artificial intelligence, mapping architecture and programs, security systems, and mechanical devices — to name a few. She represents clients before Federal District Courts across the country, the International Trade Commission, and the Patent Trial and Appeal Board in post grant proceedings. Her extensive trial experience puts her in a unique position to analyze and evaluate intellectual property litigation from inception to termination.
Additionally, Niky practices before the Patent and Trademark Office. In conjunction with traditional patent and trademark prosecution, Niky assists her clients with patent and intellectual property strategy and complex portfolio development and management. She also uses her broad and comprehensive experience when advising clients on how to effectively license and monetize their intellectual property assets.
Previously, Niky worked with the Washington State Attorney General's Office. As an Assistant Attorney General, she represented various state agencies in civil proceedings. She litigated numerous trials, represented the State in various motions and hearings, argued cases before the Washington Court of Appeals, and represented the State before the Washington Supreme Court. 

The Hitchhiker’s Guide to Data-Driven Patent Practice and Resources

The profession of patent law is becoming increasingly driven by data and statistics. Analytics services, like Juristat, offer profiles of patent examiners for use by patent practitioners - as well as profiles of law firms and patent practitioners, which applicants are using to make hiring and retention decisions of patent counsel.
Also, the USPTO holds an enormous amount of valuable data about patents, patent applications, prosecution histories, and office actions. In addition to traditional user-oriented interfaces such as PAIR, the USPTO now provides access to this data via bulk downloads and application programming interfaces (APIs). However, many practitioners are unaware of the existence of these data sources, and persistent challenges with the quality and accessibility of the data may limit their use.
During this presentation, David will provide an overview of the existing patent analytics services and USPTO data sources. David will also discuss and demonstrate some uses of these resources to facilitate day-to-day patent practice and to develop a deeper understanding of the USPTO and the patent field.

David Stein has been engaged in patent preparation, prosecution, and portfolio management since 2007, during which David has represented industry-leading international and domestic companies, startup ventures, and individuals in the fields of software, computer, and electronics. David graduated from Case Western Reserve School of Law in 2002 and is licensed to practice before the U.S. Patent & Trademark Office and in the State of Ohio.
David’s technical background includes an M.S. in Computer Science, a B.S. in Electrical Engineering, and a B.S. in Biology. David practices in the full spectrum of computing technologies, as well as computational life sciences. Currently, David focuses on Artificial Intelligence and Machine Learning, including graduate-level classes and Coursera professional certificates from Google and DeepLearning.AI.

Now is the time to step into ePCT world, a WIPO’s portal, and learn how to use it for PCT filings. This Webinar will instruct on how to set up your own account with WIPO and will include a demonstration on how to prepare and file PCT application in RO/US using ePCT. If time allows, use of ePCT to file directly in RO/IB will be also demonstrated.

Bruce Young is an independent patent agent in solo practice and has been a NAPP member since 2012, attending every AMC in that time. Mr. Young holds a Bachelor of Science degree in Computer Engineering from Iowa State University, and a Master of Science degree in Electrical Engineering from Stanford University. He currently lives in Le Mars, IA with Debra, his wife of 40 years.Before starting his patent practice, he worked for 30 years as an engineer and engineering manager in both Fortune 100 and small companies, including Jabil, Gateway, Intel, Lucasfilm/Pixar, HP, and several start-ups.
Mr. Young has been involved in nearly every aspect of electronic product design and manufacturing at some point in his career including the development of several industry-standard specifications including HiPPI and PCI, and has been named as an inventor on 41 issued US Patents.

Patenting through a $ Lens

Patents are potential tools to capture profit for a business. As practitioners, we should be knowledgeable on many issues that the client can act upon to capture as many IP rights as the client deserves. However, all actions are associated with costs. The client may decide what is and what isn't worth pursuing for their business.
This presentation proposes a rational, quantitative method for evaluating which patenting options are worth pursuing. The method is applicable to preparing applications, responding to office actions, deciding on international filings, paying maintenance fees/annuities, and any other tasks that incur costs to the business.
Some attendees may take away a methodology to use with their clients. Others will at least get some new ideas for looking at the business of patenting. All attendees will receive a free copy of a spreadsheet used for a discounted cash flow.

Jonah Probell is a US registered patent agent and the in-house patent strategist for SoundHound, a software company that uses AI for music and speech recognition and natural language processing. He has worked in various engineering and marketing roles in a handful of small companies, including co-founding two startups. Jonah has been a member of NAPP for 5+ years and is quite active in discussions in the NAPP forum and local meet-ups.
