"Implications of File History Estoppel During Litigation"
Through various examples, this presentation will provide insights into how statements made and actions taken during prosecution impact litigation, particularly during claim construction and arguments regarding invalidity. 
Presenter: Niky Bagley
Niky's practice is focused on patent and other intellectual property litigation in a variety of forums. She has litigated a wide range of cases on both the plaintiff and defense side, primarily involving the electronic arts and software design and application, including microprocessors and integrated circuits, sensors and detectors, virtual reality interfaces, encryption algorithms, artificial intelligence, mapping architecture and programs, security systems, and mechanical devices — to name a few. She represents clients before Federal District Courts across the country, the International Trade Commission, and the  Patent Trial and Appeal Board in post grant proceedings. Her extensive trial experience puts her in a unique position to analyze and evaluate intellectual property litigation from inception to termination. 
Additionally, Niky practices before the Patent and Trademark Office. In conjunction with traditional patent and trademark prosecution, Niky assists her clients with patent and intellectual property strategy and complex portfolio development and management. She also uses her broad and comprehensive experience when advising clients on how to effectively license and monetize their intellectual property assets. 
Previously, Niky worked with the Washington State Attorney General's Office. As an Assistant Attorney General, she represented various state agencies in civil proceedings. She litigated numerous trials, represented the State in various motions and hearings, argued cases before the Washington Court of Appeals, and represented the State before the Washington Supreme Court.
Niky proudly serves as an Adjunct Professor at Texas A&M School of Law and is a contributor to scholarly discourse. She is also involved in a variety of community organizations, including active membership with the Texas Patent Pro-bono Advisory Committee, the Dallas Bar Association’s Intellectual Property Council, the Dallas IP CLE Committee, and the State Bar of Texas Patent Committee. Niky was named a 2019-2020 Global Fellow of the Federal Circuit Bar Association.
