US Patent Practice

USPTO’s E-Office Action Pilot Program

Last month the USPTO began a pilot program whereby a limited number of users of Private PAIR were provided the option to receive notification via e-mail of correspondence from the USPTO about their patent applications retrievable via Private PAIR.  The e-mail notification is an automated response from the USPTO signaling the applicant that an item of Office correspondence has been entered into the record (and not an e-mail sent by the examiner). 

The e-Office Action Pilot Program, which is already fully subscribed to, will proceed for about 6 months prior to evaluation of its success (or lack thereof).

USPTO’s Fiscal Year 2006
 

In Fiscal Year 2006, the USPTO set new records in goals related to quality, production, electronic filing, telework, electronic processing, and hiring.

 

Regarding Quality and Production of patents, examiners achieved the lowest patent allowance error rate (3.5%) in more than 20 years, and the lowest patent allowance rate (54%) on record.  Read more at: www.uspto.gov/web/offices/com/speeches/06-73.htm.

Accelerated Examination: Procedure

Summary: A “new” application that has not received any examination may be granted special status for accelerated examination within 12 months if the applicant: submits a petition to make special; presents all claims directed to a single invention; submits a statement that a pre-examination search was made; submits a copy of the references deemed most closely related to the claimed subject matter; and submits a detailed discussion of how the claimed subject matter is patentable over the references.  Click here to access the article (PDF).
